Sports law expert, Miguel Galán, explained the potential legal consequences that Andorra club goalkeeper, Jesús Auno, may face against the backdrop of the violent collision that led to the death of CD Tenerife player, Jesús de Miguel, as a result of cardiorespiratory arrest on the field.
Galland’s clarification came in response to numerous inquiries on social media platforms about the possibility of the goalkeeper bearing criminal liability as a result of this tragic incident.
In an analysis published through his official accounts, the legal expert relied on judicial jurisprudence, most notably Supreme Court ruling No. (STS 379/2025) issued last April 30, showing that determining liability does not depend only on the gravity of the result, but is fundamentally based on “the player’s intention.”
Galan stated that “the current approach of the Supreme Court tends toward preserving the case or ruling acquittal in cases of competition for the ball and interventions that are not properly timed.”
He added that “recklessness” or lack of caution in sports injuries is not considered a crime punishable by criminal law, as long as the intervention remains within the scope of what is known as “permissible risk” in the sports context.
