All of these expectations and analyzes are far from reality by virtue of the constitution and the laws in force. Article 17 of the constitution dominated the procedural authority in the Council of Ministers. Article 65 of the constitution literally stipulated: “The procedural authority in the Council of Ministers, a authority to which the armed forces are subject to …”. Also, Article 49 of the constitution stipulates that the President of the Republic heads the Supreme Council of Defense, and he is the Supreme Commander of the Armed Forces, which is subject to the authority of the Council of Ministers … ”
All of this to say that the armed forces, including the Lebanese army, are subject to the authority and decision of the Council of Ministers.
Returning to the National Defense Law, issued by Decree No. 102/1983, specifically to the text of Article Five of it, it is clear that the army exercises its powers in accordance with the provisions of the constitution and the laws in force.
Also, Article 6 of it stipulates that the Council of Ministers is the one who decides the defensive and security policy, assigns its goals, and is honored to implement it. Also, Article 8 of the same law states that it requires the Supreme Defense Council to implement the defense policy, as determined by the Council of Ministers and its approval. In summary, based on the provisions of the constitution and the provisions of the laws in force, especially the National Defense Law. Who determines the defense and security policy, and whoever makes decisions in public policy is the Council of Ministers. The Lebanese Army Foundation has its task to implement these decisions and implement them.
