Member of the Democratic Gathering, Representative Bilal Abdullah, submitted a law proposal to the Parliament aimed at regulating the priority of appointment to the position of “Assistant Controller” within the staff of the Customs Administration in the Ministry of Finance. The proposal stipulates that absolute priority be given to those who succeeded in the previous competition according to the order of their success, before announcing any new competition or making additional appointments to the same job.
The proposal prohibits organizing any new competition or making new appointments to the position of assistant observer, before completing the appointment of the number specified in accordance with Council of Ministers Resolution No. 124 issued on May 13, 2009. This is done according to the order of success of the candidates who passed the competition, the results of which were issued by Civil Service Council Resolution No. 2/380 dated December 22, 2011, stressing that appointing a number of previously successful candidates does not negate the priority of the rest when vacancies become available or the actual need for appointment becomes available.
According to Article Two, positions noted in the staff are considered vacant for law enforcement purposes, in addition to positions that arise as a result of actual vacancy or a duly proven need for assistant customs observers. The Council of Ministers and the Civil Service Council are responsible for taking the necessary measures to complete the appointments duly and after verifying that the legal conditions are met.
The proposal specifies cases where the successful person may lose his right to priority in appointment, which include: a written declaration of unwillingness, unjustified failure to complete documents within the specified deadline, missing one of the legal conditions for appointment, or inability for legal or factual reasons such as death or disability, so that priority goes directly to the next candidate in the order of results. This law shall enter into force immediately upon its publication in the Official Gazette.
Regarding the reasons for the proposal, MP Bilal Abdullah pointed out that the fact that many of the winners in the 2011 match remained outside the board of directors posed the need to benefit from them before resorting to new matches. He stressed that adopting the order of success achieves equality and preserves the rights of candidates without meaning automatic appointment, as it remains conditional on the availability of legal conditions and actual vacancies, and the establishment of a legal framework that ends any previous problems in the appointment mechanism.
